On the evening of Sept.21, 2016, Suzayet Khan, a sales person from Right at Home Realty Inc., booked an appointment with me to have a showing of Unit 204 at 35 Strangford Lane at 2:00 p.m. on Thu, Sept.22. I arrived there at 1:45 p.m., 15 minutes earlier than scheduled time. I had since been awaiting him there for over 45 minutes, however, Suzayet did not show up. While waiting there for Suzayet, I met three next-door neighbours who told me that the owner is a couple, one is a taxi driver, who came from Bangladesh, and another is a housewife. They moved in five years ago with a kid, and moved out one year ago with three children. After moving out of this Unit, the couple rented it to different tenants. The current tenant who rents the Unit came from Quebec. At around 2:35 p.m., another sales person, Balu Shanmuga from Homelife Galaxy Real Estate Ltd. arrived, parked his van on the lane, got off the van, and talked to somebody via his cell at the entrance to 38 Strangford Lane. When done, Balu returned to his van. Before he left, I approached him and asked him help me call Suzayet with his cell. Balu did call Suzayet directly at 416-723-8700 provided, but Suzayet did not answer the call. Seeing there's no sign that Suzayet would show up, ten minutes later, I left. As soon as I returned home, I found Suzayet left two messages in my voice mailbox. In one message left at 1:15 p.m. when I was on my way to the destination, Suzayet wondered whether I would be there as scheduled and would like to confirm this with me. Suzayet spoke English with an Indian accent. In the other one at 3:12 p.m., he said that he would leave 204-35 Strangford Lane again, that he had been there earlier and left, and that he came back after receiving a call from somebody (Balu). Do you believe what he said? A reasonable person may assume that he may not be there this afternoon. When returning his calls in the evening, I was told that he lives at Macey Apartment around Victoria Park subway station, the apartment of which is very close to the Unit for sale, and that the reason he showed up at 2:45 p.m. after I just left was that so many people broke their promises before and that he assumed I would do so, too. Is it fair to me? Based on what he explained, I believe he prejudiced against me. Pursuant to the relevant provision under Section 3 captioned "Obligations of Registrants" of Code of Ethics (O.Reg. 580/05) under REBBA 2002, "A registrant shall treat every person the registrant deals with in the course of a trade in real estate fairly, honestly and with integrity." Given that Suzayet treated me unfairly due to prejudice, a reasonable person may not consider Suzayet reliable, honest, and with integrity.
